Any product sold to you by Westchester Wine Warehouse is sold in New York, and title passes to you, the buyer, in New York at the time of sale. You assume and take title to your wines in New York upon purchase. You are responsible for the shipment of all orders you place with Westchester Wine Warehouse. By requesting that your wine be shipped to you, you are authorizing us to engage a common carrier (i.e. FedEx) to deliver your wine on your behalf. Westchester Wine Warehouse is not responsible for any breakage or damage of wine by said common carrier. Westchester Wine Warehouse only acts as your agent in the shipping/delivery of your wine. We make no representation to the legal rights of anyone to ship or import wines into any state outside of New York. You, the buyer, are solely responsible for shipment of alcoholic beverage products and assume all obligations for compliance with your State's laws.
Policy on Purchasing Products from Westchester Wine Warehouse
Your acceptance of these Terms of Sale will be acknowledged by the creation of an online account at westchesterwine.com, Westchester Wine Warehouse, for all orders placed on our website, each time you place an order. By accepting these Retail Conditions of Sale, you are accepting them for the duration of your buying relationship with Westchester Wine Warehouse, which will allow you to make other retail purchases over the phone or through email should you choose to. We will notify you of changes to our Retail Conditions of Sale as they may occur in the future. We appreciate your business and thank you for taking time to read and understand this document.
By placing an order for wine, the Buyer warrant that they are at least 21 years of age, and that they will be responsible for the shipment of this wine being received by a person at least 21 years of age.
Any wine sold to you by Westchester Wine Warehouse is sold in New York, and title passes to you, the buyer, in New York at the time of sale.
Since these laws may affect your purchase of wines from Westchester Wine Warehouse, we urge you to investigate the laws in your state regarding this subject before shipping or arranging to ship any wine purchased from us. Buyers (not Westchester Wine Warehouse) are the owners and shippers of all wine purchased in New York from Westchester Wine Warehouse. As your agent, we will be pleased to choose a licensed common carrier on your behalf, with various levels of service typically available. If buyers wish to arrange delivery of their wines after purchase, they are responsible and bear all risk, including selecting a carrier and providing delivery instructions.
Purchaser will be assessed a 10% return/restocking fee should the shipment be returned to Westchester Wine Warehouse due to but not limited to the following: no person at least 21 years of age at the address; the address provided is not valid; the shipment is refused by the recipient.

You, the buyer, are solely responsible for shipment of alcoholic beverage products and assume all obligations for compliance with your State's laws.
If Westchester Wine Warehouse, for any reason, is unable to fulfill its obligations to the Buyer, Westchester Wine Warehouse’s sole obligation and the Buyer's sole recourse shall be a refund of the purchase price.
Westchester Wine Warehouse makes no warranty, expressed or implied, about the wine being sold except that Westchester Wine Warehouse is conveying clear title to the wine and, to Westchester Wine Warehouse’s knowledge, the wine is what its label describes it to be. Specifically, because wine by its nature is subject to change in the bottle over time, Westchester Wine Warehouse makes no warranty or guaranty of the quality or drinkability of any wine sold.
THE WARRANTIES SPECIFIED IN THIS CONTRACT ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. This contract is entered into in New York and shall be enforceable there under the laws of that State.
All sales are made in New York. Payment in full is due upon confirmation of orders. All shipping costs, including insurance, are to be paid by the Buyer. New York sales tax is payable on all taxable goods delivered in New York. Wines may be sold and delivered only to persons who are 21 years old.
Westchester Wine Warehouse makes no representation to the legal rights of anyone to ship or import wines into any state outside of New York. The Buyer is solely responsible for the shipment of wines and is responsible for any loss or damage to goods once they have left our premises. By placing an order, you authorize Westchester Wine Warehouse to act on your behalf to engage a common carrier to deliver your order to you.
Westchesterwine.com permits all orders to be submitted via checkout. Upon review of your order our customer service team may contact you to discuss possible applicable delivery options.
All transactions undergo a thorough review prior to processing and shipment to ensure accuracy in item descriptions, photographs, pricing, vintage, availability, and material information verification. We reserve the right to cancel transactions following our review for any reason. Items listed constitute an offer to purchase; thus, any transaction submitted is non-binding and does not finalize the sale of the item(s).

Prices
Prices stated on this website are for online purchase only and will not be honored for in-store purchases.
If you wish to purchase an item for the price stated on this website in our store please order it online and select in-store pickup as your shipping option.
Westchester Wine Warehouse prices are good while supplies last. Discount and/or promotions cannot be applied to previous purchases, futures or gift orders. Westchester Wine Warehouse reserves the right to correct errors on pricing and to limit quantities ordered. Prices subject to change without notice. Westchester Wine Warehouse is not responsible for typographical errors.
Payment Policy (Credit Card, Cash, Wire Transfer)
Purchases by Credit Cards may not exceed $5,000. Remaining balances can be paid by check or wire transfer. Contact us for bank wire instructions or to make payment arrangements at 914-824-1400.
You will be charged as the items are shipped. If you are paying by credit card a preauthorization occurs through your bank when the order is initially placed. This is temporary, and your card is not actually charged until the order leaves our store. The preauthorization will drop off in 1-5 business days depending on your bank.
Upon conducting our thorough review of each transaction, it may be necessary for us to request payment through wire transfer or in cash. We retain the discretion to cancel any order that we consider to be questionable for any reason. Should such a situation arise, we will reach out to you directly to coordinate payment via wire transfer or in cash at the time of pickup. In the event of an order cancellation, please be assured that your credit card will not be charged. Additionally, it is important to note that the receipt of an order does not create an obligation on our part to fulfill it. We are committed to maintaining clear and open communication throughout this process.
Cancellation and Exchange Policy
Westchester Wine Warehouse, in its own discretion, reserves the right, for whatever reason, to refuse: to cancel an order or to accept a return or exchange of items. Special Order items are non-returnable.
Westchester Wine Warehouse does not offer refunds or exchanges on any order delivered internationally; nor does Westchester Wine Warehouse refund or replace any wines over 5 years of age.
Westchester Wine Warehouse strongly believes that proper storage is crucial to maintain the quality of wine and realizes that it is not able to control how wine is stored after it leaves our store/warehouse. Therefore, returns and/or exchanges are at the discretion of Westchester Wine Warehouse and are subject to product inspection.
Cancellation Policy
Cancelled orders are orders that that have not yet been delivered but finalized charges have been issued. When canceling an order a restocking fee of 10% may be assessed at the time of the issuance of a credit. Specially ordered product can not be cancelled once arranged. All cancellations are at the discretion of Westchester Wine Warehouse.
Exchange Policy
Exchanges may only occur within the store. Exchanged purchases are only accepted within 14 days of the purchase date and must have a sales receipt or valid packing slip. Specially ordered products and wine over 5 years of age cannot be exchanged. All Exchanges are subject to product inspection and are at the discretion of Westchester Wine Warehouse.
Return Policy
Returned orders are any order that has been delivered and then returned or declined upon delivery. A restocking fee of 20% of the sales amount is assessed upon all returned orders. Special Order items are non-returnable. Shipping/Delivery costs are non-returnable.
In the event that you have to return the merchandise
Re-pack the items in its original shipped packing to ensure safe return. Make sure the original cork is included as well as any of the bad liquid or wine. Upon arrival at our store, all returned items are inspected. You will be refunded the full cost of the merchandise and all shipping charges if your return is a result of our error.
ALL RETURNS MUST BE SENT BACK IN THE ORIGINAL PACKAGING. PLEASE MAINTAIN BOXES AND THEIR INSERTS.
We will not be able to accept any returned items if the original box and interior packaging are not present.
Damage or Breakage During Transit
Should breakage or another incident occur while your package is being shipped, we will file a claim to the shipping carrier on your behalf.
Expect to receive the refund within two weeks from shipping your return to Westchester Wine Warehouse, LLC. This includes conservative estimates of the time required for the return shipping, inspection at our facility, and processing from your bank or credit card company. We will notify you via email with the details of your refund. You will receive your refund via the form of payment that you used.

Special Orders
Special orders or specially ordered product are items that have been acquired specifically by Westchester Wine Warehouse at the client’s request as they were not a regularly stocked item at the time of purchase. Specially ordered product cannot be cancelled or returned. Specially ordered items include special size requests for pre-arrivals or futures.
